The protection of your privacy when we process your personal data is an important concern for us. When you visit our website, our web servers automatically store the IP of your Internet service provider, the website from which you visit us, the pages which you visit when you are on our website, as well as the date and duration of the visit. This information is essential for the technical transmission of the web pages and for secure server operation. No personalised evaluation of this data is carried out.


If you send us data via the contact form, we will collect your name, email and your message. This data is collected in order to reply to you and will be used by us only to process your request. Providing phone number as a mean to contact you is optional. This data is stored on our servers as part of the data back-up process. Your data will also be dealt with in the strictest of confidentiality. There is no disclosure to third parties.


Personal Data

Personal data we collect includes your name, address and email address. You do not have to disclose any personal data in order to be able to visit our Internet site. In some cases, we need your name and address as well as further information in order to be able to offer you the requested service.

Automatically stored non-personal data

This anonymised data is then stored on secure systems – separately from personal data – and cannot be matched to any specific individuals. This means that your personal data is protected at all times.

Cookies

Cookies are small files that are transferred from an Internet server to your browser and stored on its hard drive. The legal basis for the use of cookies is Art. 6 para. 1 lit f DSGVO. Only the Internet protocol address is saved during this process – but no other personal data. Google Tag Manager

This website uses Google Tag Manager. The Tag Manager does not collect any personal data. The tool ensures that other tags are triggered, which may in turn collect data. Google Tag Manager does not access this data. If deactivation has occurred at domain or cookie level, this remains in place for all tracking tags which are implemented with Google Tag Manager. Google Analytics with Anonymisation Function

We use Google Analytics, a web analysis service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereafter referred to as “Google”. Google Analytics uses so-called “cookies”, text files which are saved on your computer and as a result enable you to analyse the use of the website.

The information generated by these cookies, such as the time, place and frequency of your website visit, including your IP address, is transmitted to and stored by Google in the United States.

We use Google Analytics on our website with the addition “_gat._anonymizeIp”. In this case, your IP address is shortened by Google within Member States of the European Union or in other contracting states of the European Economic Area Agreement and therefore made anonymous.

Google may also transfer this information to third parties if this is required by law or if third parties process this data on Google’s behalf.

In addition, Google offers a deactivation add-on for the most common browsers, which gives you more control over which data Google collects about the websites you visit. If you have agreed that your web and app browser history may be linked by Google to your Google Account and that information from your Google Account may be used to personalize advertisements, Google will use your information together with Google Analytics data to create target group lists for cross-device remarketing. For this purpose, Google Analytics first collects your Google authenticated ID on our website, which is linked to your Google Account (i.e. personal data). Google Analytics will then temporarily link your ID with your Google Analytics data in order to optimize our target groups.

Google Doubleclick

Doubleclick by Google is a service of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Doubleclick by Google uses cookies to present advertisements to you which you may find relevant. Your browser is assigned a pseudonymous identification number (ID) to check which advertisements have been displayed in your browser and which have been accessed. The cookies do not contain any personal information. The use of DoubleClick cookies only allows Google and its partner websites to place advertisements based on previous visits to our or other websites on the Internet. The information generated by the cookies is transmitted by Google to a server in the USA for analysis, where it is stored. Google complies with the data protection provisions of the “Privacy Shield” agreement and is registered with the US Department of Commerce’s “Privacy Shield” program. The data is only transferred by Google to third parties on the basis of legal regulations or within the scope of order data processing. Under no circumstances will Google combine your data with other data collected by Google.

By using our website, you declare your agreement to the processing of the data collected about you by Google and the method of data processing described above, as well as the stated purpose. This function is used to present interest-based advertisements to website visitors within the Google advertising network. This technology enables us to automatically generate target group-oriented advertising after your visit to our website. The advertisements are based on the products and services which you clicked on during your last visit to our website. Google Ad Services / Google AdWords Conversion Tracking

This website uses tools for the “online marketing” of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This serves the purpose of ascertaining that a visitor has accessed our website via a Google advertisement. Google uses cookies that are stored on your computer and allow an analysis of the use of the website. The cookies for so-called “conversion tracking” are set when you click on an advertisement posted by Google. Facebook Custom Audiences Pixels

We use “Custom Audiences Pixel” from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) to present interest-based advertisements to visitors to our website during their visit to Facebook. For this purpose, we have implemented a pixel of Facebook on our website, which establishes a direct connection to the Facebook servers when you visit our website. Information is sent to the Facebook server that you have visited our website and Facebook is assigning this information to your personal Facebook user account. Newsletter


Subsequent we want to explain our newsletter contents, the signup, delivery and statistical analysis processes as well as your rights of withdrawal. With subscribing to our newsletter you agree to these terms.


We only send out Newsletter, e-mails and further electronical messages with commercial purpose (hereby “newsletter”) only with your explicit opt-in or based on a legal allowance. As long as the contents are described appropriately during subscription-process, those are basis for your agreement.

Furthermore, our newsletter contains information about frequent offers and campaigns.


Subscribing to our newsletter works with the double-opt-in process. This means, after entering your email address you will receive an email with a confirmation link. This is necessary to prevent spam.

The subscription is being logged in order to adhere to legal requirements. This includes logging the subscription and confirmation time as well as the IP-address. Furthermore, your data changed within Mailchimp will be logged.


Our newsletter is distributed via “Mailchimp”, a mailing-platform from the US-based provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

Both the email addresses of our subscribers as well as the gathered data (as explained here) are kept on Mailchimp servers in the USA. Mailchimp uses those data for sending out and analysing the newsletter on behalf of AYANI.

Furthermore, Mailchimp can use this data in order to improve their own service, e.g. optimizing the technical distribution, displaying the email appropriately or for commercial reasons do distinguish the country where the receiver is localized. Mailchimp is not providing the data to any third party.


We trust in the reliability of Mailchimp’s IT and data security. Mailchimp is certified under the US-EU-data protection agreement „Privacy Shield“ and hereby commits to comply with European data protection law. Furthermore, we have signed a „Data Processing Agreement“. In this agreement Mailchimp commits to protect our customers’ data, process our data based on EU data protection law and particularly does not pass on the data to any third party. To subscribe to our newsletter it is sufficient to provide your email-address.


The newsletter contains so-called “web-beacons”. That is a pixel-sized file, which is called by the Mailchimp server when opening the newsletter. With this call, technical information as to the used browser, your system, IP-address and point of time are stored. This data is used to improve the technical services and distribution quality. Also information is stored on if and when the newsletter was opened by the user and as well as which links have been clicked.

This information can indeed be related to a specific user, but we explicitly insist on not tracking a single user both AYANI nor Mailchimp. These information only help us to identify general user behaviour due to the usage of our newsletter and to improve the contents towards better user experience for our subscribers.


You can withdraw your subscription at any time. This includes the withdrawal of receiving our newsletters from Mailchimp and being part of statistical analysis. Every newsletter email contains an unsubscription link. To unscribscribe, simply click the “Unsubscribe” link in the footer of any of our product recommendations or send an email to support@ayani.co.


Based on the requirements of the general data protection regulation (GDPR) as of 25th of May 2018 we inform you, that your subscription of our newsletter is based Art. 6 Abs. 1 lit. a, Art. 7 DSGVO as well as § 7 Abs. 2 Nr. 3, bzw. Abs. 3 UWG.


Using Mailchimp, applying statistical analysis as well as the subscription process are based on our legitimate interest as per 6 Abs. 1 lit. f DSGVO. Our interest goes towards using a both user-friendly as well as secure service provider, that adheres both to our commercial needs as well as our customer’s expectations.


We inform you, that you can withdraw future data processing of your personal data as per Art. 21 DSGVO at any time.

 

Customer Account


For each customer who registers accordingly, we set up password-protected direct access to their stored inventory data (customer account) stored by us. Here you can view data about your completed, open and recently sent orders and manage your address data, bank details and the newsletter. You undertake to treat the personal access data confidentiality and not to make it accessible to any unauthorised third parties. We cannot accept any liability for the misuse of passwords unless we are responsible for the misuse.

 

Disclouse of Data to Third Parties for Contractual Purposes

 

We will share your personal data with third parties only if you have expressly agreed to this, if we are under a legal obligation to do so, or if this is required in order to assert our rights, in particular to enforce claims arising from the contractual relationship.

Beyond this, we will pass your data on to third parties to the extent that this is necessary for processing the contract. We collaborate with external companies for the purpose of processing our various payment transactions: This is Paypal Deutschland GmbH, Am Marktplatz 1, 14532 Europaparc Dreilinden, when paying via Paypal  and Klarna AB, Sveavägen 46, 111 34 Stockholm, Schweden when paying via Klarna. Klarna reviews and evaluates the data you provided and in case of legitimate interest performs a data exchange with other companies and credit rating agencies. Your personal data will be processed in accordance with applicable data protection law as described in Klarna privacy statement.

Further third party providers, that are necessary for carrying out the contracts are: shipping provider. In any case we strictly adhere to legal requirements. Persisted data limits to the necessary minimum. Personal data will not be disclosed to third parties for any other purpose.


Safety

We have taken technical and administrative security precautions to protect your personal data against loss, destruction, manipulation and unauthorised access. All of our employees and the service providers working for us are obliged to comply with the valid data protection laws.

Whenever we collect and process personal data, it is encrypted before being transmitted. This means that your data cannot be misused by third parties.
